9. Intellectual Property. We do not claim any ownership in the intellectual property rights of others. All product, brand, or company names not belonging to Us are the intellectual property of their respective owners.
10. DISCLAIMER. THE SOFTWARE AND INFORMATION CONTAINED ON THIS WEBSITE IS PROVIDED ‘AS IS‘ WITHOUT WARRANTY OF ANY KIND. THE ENTIRE RISK AS TO THE RESULTS AND THE PERFORMANCE OF THE SOFTWARE AND INFORMATION CONTAINED ON THIS WEBSITE IS ASSUMED BY THE USER, AND IN NO EVENT WILL WE (INCLUDING AFFILIATES AND FAMILY MEMBERS OF THE SCIENCE IN SPORT COLLABORATORS) BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL OR DIRECT DAMAGES SUFFERED IN THE COURSE OF USING THE SOFTWARE AND INFORMATION CONTAINED ON THIS WEBSITE.
11. CANCELLATION AND RETURNS POLICY
11.1 You have a period of twenty-eight (28) days starting on the day after the day you take delivery of your products in which to cancel your order for any reason and receive a refund. This right applies in addition to your rights under Condition 11.8 and includes the seven (7) day cooling off period available to you under the Distance Selling Regulations.

11.3 If you exercise this right to cancel, you must take reasonable care of the unwanted products and return them to us at your own expense. You may like to use a recorded delivery service to ensure that returned items arrive with us safely (and we particularly recommend this for higher value items). Please note that, except under Condition 11.8 below, we do not accept return of products that have been used or taken out of sealed packaging (although we do not consider shoes to have been ‘used‘ if they have been tried-on, unless their soles or other parts show signs of wear as a result).
11.4 Some of our products are subject to special transportation requirements because they come in aerosols or contain flammable ingredients. These items should not be sent by Royal Mail. If you want to return these items we can arrange for them to be collected from you by our carrier on request, but we will charge you for the cost of collection or deduct it from any refund that is due to you. If we do arrange a collection, then you must ensure that someone is available at the collection address to hand the items to our carrier at the designated time.
11.5 We will refund the price you paid for products that are returned under Condition 11.1 within thirty (30 days. This refund will include our delivery charge unless that charge also included other products that you have not returned. We cannot refund the costs of any associated pre-delivery service such as gift-wrapping. We reserve the right to deduct our reasonable direct costs of recovering products that you fail to send back from any refund that we may give. We may be entitled to claim compensation from you if you fail to take care of the products before returning them to us.
11.6 In the unlikely event that you receive items that you did not order, or that are damaged or defective, or that are not in the quantity you ordered, you should contact us at our Contact Us page so that we can investigate your concerns and provide you with details of what to do next. You should retain the product concerned and its original packaging to enable us to do this.
11.7 If you have received less than the quantity of Products that you ordered, we will use our reasonable endeavours to make up any shortfall or else give you a refund for the undelivered items.
11.8 We will take back (at our own cost) any products that are damaged or defective or that have been delivered to you in error. We may arrange with you that our carrier will collect those products from you (in which case someone must be available at the collection address to hand them to our carrier at the designated time), agree to reimburse your reasonable costs of returning them to us, or else ask you to throw them away. We will, at our option, replace or give you a refund for any damaged or defective products. Please note that this does not apply to products that have simply suffered fair wear and tear or that have been lost or damaged after their delivery to you).
11.9 The above rights of cancellation and return do not affect your statutory rights.
12. Miscellaneous. This Agreement, including any and all documents referenced herein, constitutes the entire agreement between Science in Sport and You pertaining to the subject matter hereof. A failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provisions or rights. If any of the provisions contained in these terms and conditions are determined to be void, invalid or otherwise unenforceable, such determination shall not affect the remaining provisions contained herein. These terms and conditions shall be governed by and construed in accordance with the substantive laws. Unless otherwise agreed in writing, any disputes shall be resolved through good faith negotiation; if disputes remain unresolved after negotiation, the Parties agree to utilize a simple and mutually acceptable form of alternative dispute resolution that may be conducted through telephonic or electronic means. This Agreement shall be binding upon and shall inure to the benefit of the Science in Sport Collaborators (including affiliates and family members of the Science in Sport Collaborators), their heirs, successors, and assigns. We may change these terms and conditions from time to time. By continuing to use the Science in Sport Website after such change has been provided on a Website relating to Science in Sport for the first time, You signify your consent to the revised terms.
